Terms of Service
1. Definitions
Website: https://smotors.pl
User: Any natural or legal person visiting the Website
Client: A User who books or purchases workshop services
Service Provider: SMOTORS Polska Sp. z o.o., Dobrego Pasterza 191, 31-416 Krakow, Poland
2. Acceptance of terms
By using the Website, you confirm that you have read and accept these Terms and the Privacy Policy. If you do not agree, do not use the service
3. Scope of services
The Website allows Clients to:
- browse information about mechanical, diagnostic, and tire services;
- submit quote requests;
- book service appointments
4. Booking and contract conclusion
The contract is concluded upon confirmation of the appointment by email or SMS. Online prices are indicative; the final price is confirmed after vehicle inspection at the workshop
5. Payments
Payment is due after the service is completed, unless otherwise agreed. We accept cash, bank transfer, or card (if a terminal is available). Prepayments (if any) are treated as advances and deducted from the final invoice
6. Right of withdrawal (consumers)
If you book exclusively online, you can cancel the appointment free of charge up to 24 hours before the scheduled time or within 14 days of booking
Once the service provision has begun at the workshop, the statutory right of withdrawal does not apply
7. User obligations
You undertake to:
- provide true contact and vehicle details;
- arrive punctually or inform about delays;
- not introduce malicious software or use the Website in a manner that could disrupt its operation (Art. 8 of the Act on Provision of Electronic Services)
8. Intellectual property
All texts, logos, and images on the Website are the property of SMotors or licensors. They may not be reproduced without written consent
9. Limitation of liability
Nothing herein excludes liability for death or personal injury caused by negligence. Otherwise, the Service Provider is liable only for direct damages up to the amount actually paid by the Client for the specific service. The Website is provided "as is"; we do not guarantee uninterrupted availability
10. Complaints
Complaints should be sent to contact@smotors.pl with the subject "Complaint". We will respond within 14 calendar days
11. Governing law and jurisdiction
The Terms are governed by Polish law. Disputes shall be resolved by the competent court in Krakow, unless mandatory consumer protection laws provide otherwise
Consumers may also use the EU online dispute resolution platform: ec.europa.eu/consumers/odr.
12. Changes
We may update the Terms; the new version is effective upon publication on the https://smotors.pl/en/terms-of-service . Customers will be notified by email if changes significantly affect booked services
